Terms of Service

These Terms of Service (“Terms”) govern access to and use of HomeGoal, operated by Andreas Heinzerling (“we”, “us”). By creating an account or using the service, you agree to these Terms and our Privacy Policy.

If you are a consumer in the EU/EEA/UK, mandatory consumer protection laws apply and take precedence over conflicting contract terms where required.

1. The service

HomeGoal provides educational tools and AI-assisted coaching content to help users explore savings habits and home-buying goals. Features may evolve over time. We may update, suspend, or discontinue parts of the service with reasonable notice where practicable.

2. Not financial advice

HomeGoal is an educational and informational product. Content in the app, including AI-generated assessments, is not financial, investment, tax, accounting, mortgage, or legal advice. We do not guarantee home ownership or any particular financial outcome. You are solely responsible for your decisions and should consult qualified professionals where needed.

3. Eligibility and accounts

You must be legally able to enter a binding contract. You must provide accurate account information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use at contact@homegoal.app.

4. Subscriptions and payments

Paid access is required for core features. Prices and plan details are shown at checkout. Payment is processed by Stripe. New subscribers may receive a one-time 5-day free trial per email address. Payment details are collected when the trial starts. Unless you cancel before the trial ends, your selected plan is charged when the trial converts, and then renews automatically for the selected interval until cancelled.

If your email has already used a free trial, checkout starts a paid subscription immediately. You can manage or cancel via the billing portal where available, or by contacting us.

Taxes may apply depending on your location. Failed payments may result in suspension of access.

5. Consumer withdrawal (EU/EEA)

If you are a consumer in the EU/EEA purchasing digital content or online services, you may have a 14-day right of withdrawal under consumer law. Where you expressly request immediate performance of a digital service and acknowledge that you lose the withdrawal right once performance begins, that right may not apply after access is provided, to the extent permitted by law. Statutory warranty rights for consumers remain unaffected.

To exercise withdrawal where available, contact contact@homegoal.app with a clear statement. Refunds, if due, will be processed according to applicable law and our payment provider’s procedures.

6. Acceptable use

You agree not to:

• Misuse the service or attempt unauthorized access
• Disrupt, overload, or reverse engineer the platform
• Abuse AI features or scrape content at scale
• Use HomeGoal for unlawful, harmful, or fraudulent purposes
• Share account access in a way that circumvents billing

7. Intellectual property

HomeGoal software, branding, and content are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable right to use the service for personal, non-commercial purposes during an active subscription, except as otherwise agreed.

8. Availability and disclaimers

We aim for reliable availability but do not warrant uninterrupted or error-free operation. To the fullest extent permitted by law, the service is provided “as is” and “as available.”

9. Liability

Nothing in these Terms excludes or limits liability that cannot be limited under applicable law (including liability for intent, gross negligence, injury to life/body/health, or mandatory product liability).

Subject to the foregoing, we are not liable for indirect or consequential damages, lost profits, or losses arising from reliance on educational/AI content, to the maximum extent permitted by law. For consumers, liability limitations apply only as allowed by mandatory consumer law.

10. Termination

You may stop using the service at any time and cancel renewals as described in Billing. We may suspend or terminate access for Term violations, non-payment, security risk, or legal requirements. Upon termination, your right to access paid features ends; residual copies of data may remain in backups for a limited period.

11. Governing law and disputes

These Terms are governed by the laws of Germany, excluding conflict-of-law rules. If you are a consumer, you also benefit from mandatory protections of your country of residence. Courts at our place of business have jurisdiction for merchants; consumers may bring proceedings in their place of residence where required by law. EU consumers may use the ODR platform at ec.europa.eu/consumers/odr.

12. Changes

We may update these Terms. We will post the updated version with a new “Last updated” date. If changes are material, we will provide additional notice where required. Continued use after the effective date constitutes acceptance, except where mandatory law requires explicit consent.
